Offences Related To Documents Under IPC (Sections 463-471)

Section 463: Forgery (जालसाज़ी)

Whoever makes any false document (जाली दस्तावेज़) or false electronic record (जाली इलेक्ट्रॉनिक रिकॉर्ड) or part of a document or electronic record, with intent to cause damage or injury to the public or any person, or to support any claim or title, or to cause any person to part with property, or to enter into any express or implied contract, or with intent to commit fraud (धोखाधड़ी) or that fraud may be committed, commits forgery (जालसाज़ी).

Section 464: Making a False Document (जाली दस्तावेज़ बनाना)

A person is said to make a false document or false electronic record—

1. First — Who dishonestly or fraudulently (बेईमानी या धोखे से) makes, signs (हस्ताक्षर करना), seals (सील करना), or executes (निष्पादित करना) a document or part of a document, or makes any mark denoting the execution of a document or the authenticity (प्रामाणिकता) of a document, with the intention of causing it to be believed that such document or part of a document was made, signed, sealed, or executed by or by the authority of a person by whom or by whose authority he knows that it was not made, signed, sealed, or executed; or at a time at which he knows that it was not made, signed, sealed, or executed; or
2. Secondly — Who, without lawful authority (कानूनी अधिकार के बिना), dishonestly or fraudulently, by cancellation or otherwise, alters a document (दस्तावेज़ में परिवर्तन करना) in any material part thereof after it has been made, signed, sealed, or executed, either by himself or by any other person, whether such person be alive or dead at the time of such alteration; or
3. Thirdly — Who dishonestly or fraudulently causes any person to sign, seal, execute, or alter a document knowing that such person by reason of unsoundness of mind (मानसिक अस्वस्थता), intoxication (नशे में), or deception (धोखे के कारण) practiced upon him, he does not know the contents of the document or the nature of the alteration.

Section 465: Punishment for Forgery (जालसाज़ी के लिए दंड)

Whoever commits forgery (जालसाज़ी) shall be punished with imprisonment (कैद) of either description for a term which may extend to two years, or with fine (जुर्माना), or with both.

Section 466: Forgery of Record of Court or of Public Register, etc. (न्यायालय के रिकॉर्ड या सार्वजनिक रजिस्टर की जालसाज़ी, आदि)

Whoever forges a document or an electronic record, purporting to be a record or proceeding of or in a court of justice (न्यायालय का रिकॉर्ड या कार्यवाही), or a register of birth, baptism, marriage, or burial, or a register kept by a public servant (सार्वजनिक सेवक द्वारा रखा गया रजिस्टर) as such, or a certificate (प्रमाण पत्र) or document purporting to be made by a public servant in his official capacity, or an authority (अधिकार) to institute or defend a suit, or to take any proceedings therein, or to confess judgment, or a power of attorney (पावर ऑफ अटॉर्नी), shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

Section 467: Forgery of Valuable Security, Will, etc. (मूल्यवान सुरक्षा, वसीयत आदि की जालसाज़ी)

Whoever forges a document which purports to be a valuable security (मूल्यवान सुरक्षा) or a will (वसीयत), or an authority to adopt a son, or which purports to give authority to any person to make or transfer any valuable security, or to receive the principal, interest, or dividends thereon, or to receive or deliver any money, movable property, or valuable security, or any document purporting to be an acquittance (मुक्ति पत्र) or receipt acknowledging the payment of money, or an acquittance or receipt for the delivery of any movable property or valuable security, shall be punished with imprisonment for life (आजीवन कारावास), or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.

Section 468: Forgery for Purpose of Cheating (धोखाधड़ी के उद्देश्य से जालसाज़ी)

Whoever commits forgery, intending that the document or electronic record forged shall be used for the purpose of cheating (धोखाधड़ी के लिए), shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

Section 469: Forgery for Purpose of Harming Reputation (प्रतिष्ठा को नुकसान पहुँचाने के उद्देश्य से जालसाज़ी)

Whoever commits forgery, intending that the document or electronic record forged shall harm the reputation (प्रतिष्ठा) of any party, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.

Section 470: Forged Document or Electronic Record (जाली दस्तावेज़ या इलेक्ट्रॉनिक रिकॉर्ड)

A false document or electronic record made wholly or in part by forgery is designated as a forged document (जाली दस्तावेज़) or electronic record (जाली इलेक्ट्रॉनिक रिकॉर्ड).

Section 471: Using as Genuine a Forged Document or Electronic Record (जाली दस्तावेज़ या इलेक्ट्रॉनिक रिकॉर्ड को असली के रूप में उपयोग करना)

Whoever fraudulently or dishonestly uses as genuine any document or electronic record which he knows or has reason to believe to be a forged document or electronic record, shall be punished in the same manner as if he had forged such document or electronic record.
